This Privacy Policy explains how Barkly Connect LLC ("Barkly," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information when people use Barkly Connect websites, applications, and services (the "Services").
1. Scope and Roles
Barkly Connect is primarily a workplace SaaS platform used by organizations. In many cases, an employer or other Customer determines which individuals use Barkly, what information is entered, which features are enabled, and how workplace information is used. For that Customer-controlled information, Barkly generally processes information on the Customer's behalf. The Customer remains responsible for its own notices, permissions, employment practices, and legal obligations.
This Policy also applies to information Barkly collects for its own business purposes, such as account administration, billing, security, support, product analytics, and communications.
2. Information We Collect
Information provided by Customers and users
- Account and profile information, such as name, business email, phone number, job title, department, location, supervisor relationships, role, and organization membership.
- Organization information, such as company name, organizational structure, branding, settings, administrators, locations, job titles, and subscription configuration.
- Content submitted through the Services, such as announcements, messages, acknowledgments, polls, survey or shift-feedback responses, tracked follow-up information, comments, documents, files, and related activity history.
- Support and communications information when you contact us, request assistance, report a problem, or communicate with Barkly.
- Billing and subscription information. Payment card details are generally collected and processed by our payment processor rather than stored directly by Barkly.
Information collected automatically
- Device, browser, operating-system, app-version, IP address, language, and similar technical information.
- Authentication, access, security, audit, and activity logs.
- Usage information about interactions with features, screens, and system functions.
- Diagnostic information such as errors, crashes, performance data, and security events.
3. How We Use Information
- Provide, operate, authenticate, personalize, and maintain the Services.
- Apply tenant boundaries, organizational hierarchy, permissions, and role-based access controls.
- Deliver communications, documents, polls, feedback workflows, acknowledgments, and other requested functionality.
- Process subscriptions, maintain billing records, prevent fraud, and administer accounts.
- Provide customer support and respond to requests.
- Protect the security, integrity, availability, and lawful use of the Services.
- Monitor performance, troubleshoot, analyze usage, and improve features and user experience.
- Develop and provide optional AI-assisted features when enabled and invoked by an authorized user.
- Comply with law, enforce agreements, and establish, exercise, or defend legal claims.
4. AI-Assisted Features
When a user intentionally invokes an AI-assisted feature, the text or other information submitted to that feature may be sent to an AI service provider for processing to generate the requested output. Customers and users should not submit sensitive or regulated information to AI features unless they are authorized to do so and Barkly has expressly confirmed that the applicable use is supported. AI feature usage may also generate operational metadata such as action type, timestamps, and usage counts.
5. How We Disclose Information
- To the Customer that provides or administers your Barkly account, including authorized administrators and users according to configured roles and permissions.
- To service providers that help us host infrastructure, authenticate users, process payments, deliver transactional email, provide customer support, monitor security or performance, or provide AI functionality. These providers may process information only for the services they provide to us and subject to applicable contractual obligations.
- To professional advisers, auditors, insurers, financing sources, or transaction counterparties when reasonably necessary and subject to appropriate confidentiality protections.
- When required by law, legal process, or a valid governmental request, or when reasonably necessary to protect rights, safety, security, and the integrity of the Services.
- In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of the business, subject to applicable law.
We do not sell personal information for money. We do not use Customer workplace content for third-party behavioral advertising.
6. Payment Information
Barkly may use Stripe or another payment processor to process web-based subscription payments. Payment processors receive payment-card and transaction information directly and handle it under their own privacy and security practices. Barkly receives information needed to administer the subscription, such as customer identity, billing status, plan, payment status, and transaction identifiers. Purchases made through Apple or another app marketplace are also subject to that marketplace's privacy and payment practices.
7. Data Retention
We retain information for as long as reasonably necessary to provide the Services, maintain security and business records, comply with legal obligations, resolve disputes, and enforce agreements. Retention may vary by data type, Customer configuration, contractual requirements, and legal obligations. After applicable retention periods, information may be deleted, aggregated, or de-identified.
8. Account and Data Deletion
Users may request deletion of their Barkly account through available in-app account controls or by contacting the Customer administrator or Barkly, depending on how the account is managed. Where an organization controls the account, Barkly may route a request to that organization. We will delete or de-identify personal information that we are not required or permitted to retain. Certain records may be retained for security, fraud prevention, billing, legal compliance, dispute resolution, or other legitimate purposes.
Deleting a Barkly account does not automatically cancel a subscription billed by Apple or another third-party marketplace. Marketplace subscriptions must be canceled through the applicable marketplace. Web subscriptions should be canceled using the account or billing controls made available by Barkly.
9. Security
We use administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, and disclosure. These measures may include authentication controls, role-based authorization, tenant isolation, encryption in transit, logging, access restrictions, and security monitoring. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Children's Privacy
The Services are designed for workplace and organizational use and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13 through consumer-directed use of the Services. Customers are responsible for ensuring that any use involving minors is lawful and appropriately authorized.
11. Your Choices and Rights
Depending on where you live and the context in which Barkly processes your information, you may have rights to request access, correction, deletion, portability, restriction, or other treatment of personal information. If your account is provided by an employer or other Customer, that Customer may be the appropriate party to handle your request. You may also contact Barkly using the information below.
You may opt out of non-essential marketing communications by using the unsubscribe mechanism provided in those communications. Transactional, security, account, and service messages may still be sent when necessary.
12. International Use
Barkly Connect LLC is based in the United States. If the Services are made available outside the United States, information may be processed in the United States or other locations where Barkly or its service providers operate, subject to applicable legal requirements.
13. Changes to This Policy
We may update this Privacy Policy from time to time. We will identify the effective date and version and provide notice of material changes through the Services, by email, or by another reasonable method. If applicable law requires consent for a material change, we will obtain it.
